Privacy Policy

The Leona M. and Harry B. Helmsley Charitable Trust (the “Trust” or “we”) owns and operates the website located at www.helmsleytrust.org (the “Site”).  The Trust has created this Privacy Policy to let you know what information we may collect from you on the Site and how we may use that information. Please take a moment to review the terms of our Privacy Policy.  By using the Site, you agree to accept the terms of our Privacy Policy.  If you do not agree to the terms of this Privacy Policy, please do not use the Site. This Privacy Policy applies only to information collected on the Site.  It does not apply to information that we may collect by means other than on the Site.

1. INFORMATION WE COLLECT ON THE SITE.

Information You Provide To Us.

We may collect and process the following information about you:

Personal Information.  You are not required to provide any personal information in order to access the Site and the information available on the Site.  However, in order to take advantage of certain features offered on the Site, we may ask you to provide information that could reasonably be used to contact you, or to identify you personally, or that otherwise relates to you, such as your name, e-mail address, mailing address and phone number. 

Communications.  You may send us communications, for example to submit questions, concerns, or comments regarding the Trust or the Site or its contents; or you may provide us with a resume through the Site, which we may retain in our files in order to contact you for current or future job openings.

Information We Collect Automatically.

Site Activity.  From time to time, we may use a variety of technologies that automatically or passively collect general, non-personal, statistical information about how the Site is accessed and used, such as how many visitors visit a specific page on the Site, how long they stay on that page, and which hyperlinks, if any, they “click” on.  We collect this information through the use of technologies such as “cookies” and “IP addresses”, which are discussed in greater detail below. We may also store information that your computer or mobile device provides to us in connection with your use of the Site, such as your browser type, type of computer or mobile device, browser language, IP address, mobile carrier, unique device identifier, and requested and referring URLs.  We collect this information in order to determine which areas of the Site are most popular and to enhance the Site for visitors. We may also group this information into aggregate visitor data in order to describe the use of the Site to our existing or potential business partners or other third parties, or in response to a government request. However, please be assured that this aggregate data will in no way personally identify you or any other visitors to the Site.

IP Addresses.  An IP address is a number that’s automatically assigned to your computer whenever you’re surfing the web. Web servers, the big computers that “serve up” web pages, automatically identify your computer by its IP address. The Trust collects IP addresses for purposes of system administration, to report aggregate information to third parties and to track the use of the Site. When visitors request pages from the Site, our servers log the visitors’ IP addresses. It is not our practice to link IP addresses to anything personally identifiable, which means that a visitor’s session will be logged, but the visitor remains anonymous to us. However, we reserve the right to use IP addresses to identify a visitor only when we feel it is necessary to enforce compliance with the Site’s policies or to protect the Trust, the Site, its visitors, or others. By visiting and using the Site, you acknowledge, understand and hereby agree that you are giving us your consent to track your use of the Site as described in this Privacy Policy.

Cookies.  Cookies are pieces of information that a website transfers to an individual’s hard drive for record-keeping purposes. Cookies make web-surfing easier for you by saving your preferences while you’re at the Site.  The use of cookies is an industry standard -- you’ll find them at most websites.  By showing how and when visitors use the Site, cookies help us see which areas are popular and which are not.  Information such as the total number of visitors and pages viewed is most easily tracked with cookies. We may use the information from cookies to make improvements and updates to the Site and to tailor our services to our visitors’ needs.

3. DISCLOSURE OF PERSONAL INFORMATION.

We may share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

Third Parties Providing Services On Our Behalf.  We may share your information with third parties that perform functions on our behalf such as service providers that host or operate our Site, send postal mail, and analyze data on our behalf.  We may share information from or about you with these third-party providers so that they can perform their services or complete your requests.

Links.  The Site may contain links to unaffiliated third party websites.  Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices.  These other sites may send their own cookies to visitors, collect data or solicit personal information. The privacy policies of these other sites may be significantly different from this Privacy Policy. We are not responsible for the privacy practices of these other sites and cannot guarantee the security of any of your personal information collected there.  We suggest you read the privacy policies on all such third party websites.

Legal Disclosure.  We may transfer and disclose your information to third parties to comply with a legal obligation; when we believe in good faith that the law or a governmental authority requires it; to verify or enforce the Site’s policies; to address fraud, security or technical issues; to respond to an emergency; to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) the Trust’s rights or property, other visitors, or anyone else that could be harmed by such activities.

Business Transfers.  We may share your information with other entities and our affiliates primarily for business and operational purposes.  In the event that the Trust is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction, subject to the terms herein.

4. YOUR PRIVACY RIGHTS, CHOICE AND ACCESS.

You may always direct us not to share your information with third parties, not to use your information to provide you with information or offers, or not to send you emails or other communications by: (i) sending us an email at info@helmsleytrust.org; or (ii) following the unsubscribe instructions within the Trust’s emails.

If you wish to modify, verify, correct, or delete any of your information collected through the Site, you may contact us at the above email address.  We are under no obligation to store such information indefinitely and disclaim any liability arising out of, or related to, the destruction of such information.  It may not always be possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. 

5. SECURITY.

Protecting the security of your personal information is very important to us.  Once we receive your transmission, we will take reasonable precautions to ensure its security on our systems. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure.  As a result, while the Trust strives to protect your personal information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your personal information.

6. CHILDREN.

We do not knowingly collect, use or disclose personal information from children under the age of 18 on the Site.  This Site is not directed to children under 18.  If you are under the age of 18, please do not provide any personal information to us. If we become aware that we have collected personal information from a child under the age of 18, we will make commercially reasonable efforts to delete such information from our database.

7. CONSENT TO PROCESSING AND TRANSFER OF INFORMATION.

The Site is governed by and operated in, and in accordance with the laws of, the United States, and are intended for the enjoyment of residents of the United States.  The Trust makes no representation that the Site is governed by or operated in accordance with the laws of any other nation.  If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect may be processed in the United States.  By using the Site, or providing us with any information, you (a) acknowledge that the Site is subject to the laws of the United States, (b) consent to the collection, processing, maintenance and transfer of such information in the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen, and (c) waive any claims that may arise under those laws.

8. CHANGES TO THESE TERMS.

The terms of this Privacy Policy may change from time to time. We will notify you of any material changes to this Privacy Policy by posting a notice, on the homepage of the Site prior to the change becoming effective and for a reasonable period of time after such changes are made, that this Privacy Policy has been updated, and by changing the “Last Modified” date at the top of this Privacy Policy. We encourage you to check this page periodically for any changes. Your continued use of the Site following the posting of changes to these terms will mean you accept those changes.
